In this Privacy Policy, the terms “AI Planet,” “AI Planet”, “DPhi”, “We” and “Us” refer to DPhi Tech BV. This Privacy Policy applies to the websites accessible at https://www.aiplanet.com and https://dphi.tech/ all owned and operated by DPhi Tech BV., incorporated in Belgium.

AI Planet reserves the right to amend the Privacy Policy at any time at its sole discretion to adapt it to any new commercial or technological practice or change in the law. Should this occur, AI Planet will inform you by any appropriate means (via the website, email, and/or on the platform, e.g., banners, pop-ups, or other notification mechanisms). If you do not accept the amendments thus made by AI Planet, your sole remedy is to no longer access and/or use its Services.

If you use our services though a Free Plan or Individual Plan, AI Planet is the data controller of your personal data. This means we request and collect your personal data and vouch to work responsibly with it. We put the necessary security measurements in place, give you control over your personal data, and we respect your rights as the data subject.

If you are using our services as part of an AI Planet for Teams subscription, AI Planet is the data processor of your personal data. The organization that contracted with us for the subscription is the data controller.

1. Types of Data collected

Among the types of Personal Data that this Application collects, by itself or through third parties, there are. AI Planet collects, processes, and retains information about you when you visit the Websites or use the Services. You may choose to provide AI Planet with information, such as geographic position, email, first name, last name, bio, programming language preference, skill level, company/organization name, or other information, to use the Services or so we can follow up with you after your visit.

Other Personal Data collected may be described in other sections of this privacy policy or by dedicated explanation text contextually with the Data collection. The Personal Data may be freely provided by the Customer, or collected automatically when using this Application. Any use of Cookies - or of other tracking tools - by this Application or by the owners of third party services used by this Application, unless stated otherwise, serves to identify Customers and remember their preferences, for the sole purpose of providing the service required by the Customer. Failure to provide certain Personal Data may make it impossible for this Application to provide its services.

Customers are responsible for any Personal Data of third parties obtained, published or shared through this Application and confirm that they have the third party's consent to provide the Data to the Owner.

If you choose to participate in the AI Planet initiatives, you may choose to provide us with additional information such as social media profiles, education information, experience, and other information. Certain data elements requested of you by the Websites are “mandatory” or “required,” and failure to provide this data may make it impossible for AI Planet to provide its Services to you. In cases where requested data elements are not mandatory or required, you may choose not to provide the requested data without any consequences to the availability or the functioning of the Services. We may combine other publicly available information with the information that you provide to us to enhance and optimize our Websites and Services for you. AI Planet may observe your activities, interactions, preferences, and other computer and connection information (such as IP address and geographic location) relating to your use of the Websites and the Services. AI Planet may also use log files, cookies and similar technologies to collect information about the pages you view, links you click on, and other actions you may take when accessing the Websites and Services. We may collect and store this information and combine this information with other personal information you may have provided.

2. Mode and place of processing the Data

2.1. Methods of processing

The Data Controller processes the Data of Customers in a proper manner and shall take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Data Controller, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of the site (administration, sales, marketing, legal, system administration) or external parties (such as third party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Data Controller at any time.

2.2. Place

The Data is processed at the Data Controller's operating offices and in any other places where the parties involved with the processing are located.

2.3. Retention time

The Data is kept for the time necessary to provide the service requested by the Customer, or stated by the purposes outlined in this document, and the Customer can always request that the Data Controller suspend or remove the data.

3. The use of the collected Data

The Data concerning the Customer is collected to allow the Owner to provide its services, as well as for the following purposes: Analytics, Displaying content from external platforms, Registration and authentication, Interaction with external social networks and platforms, Geolocation, personalize and improve your experience, Managing contacts and sending messages/mails that could of your interest, Infrastructure monitoring and Hosting and backend infrastructure.

The Personal Data used for each purpose is outlined in the specific sections of this document.

4. Detailed information on the processing of Personal Data

Personal Data is collected for the following purposes and using the following services:

4.1. Analytics

The services contained in this section enable the Owner to monitor and analyze web traffic and can be used to keep track of Customer behavior. At times we may share this information in aggregated anonymous form with third parties.

4.2. Google Analytics (Google Inc.)

Google Analytics is a web analysis service provided by Google Inc. (“Google”). Google utilizes the Data collected to track and examine the use of this Application, to prepare reports on its activities and share them with other Google services. Google may use the Data collected to contextualize and personalize the ads of its own advertising network.

4.3. Google Tag Manager

This website uses Google Tag Manager. Google Tag Manager is a solution operated by Google LLC. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”) that allows marketed website tags to be managed using an interface. The Tag Manager tool itself (which implements the tags) is a cookie-less domain and does not register personal data. The tool causes other tags to be activated which may, for their part, register data under certain circumstances. Google Tag Manager does not access this information. If recording has been deactivated on domain or cookie level, this setting will remain in place for all tracking tags implemented with Google Tag Manager.

4.4. Microsoft Clarity

This website uses Microsoft Clarity, a user behaviour analysis tool offered by Microsoft. The following information collected through Microsoft Clarity is to statistically and visually analyze the usage trends of the site: Cookie and anonymized IDs User’s action history. We will use the data collected through the use of Microsoft Clarity only for analysis of the usage trends of sites, and such data will not be used to identify individuals. 5. Displaying content from external platforms

This type of services allows you to view content hosted on external platforms directly from the pages of this Application and interact with them. This type of service might still collect web traffic data for the pages where the service is installed, even when Customers do not use it.

5.1. YouTube video widget (Google Inc.)

YouTube is a video content visualization service provided by Google Inc. that allows this Application to incorporate content of this kind on its pages.

5.2. Geolocation (This Application)

This Application may collect, use, and share User location Data in order to provide location-based services. Most browsers and devices provide tools to opt out from this feature by default. If explicit authorization has been provided, the User’s location data may be tracked by this Application.

6. Interaction with external social networks and platforms

This type of services allow interaction with social networks or other external platforms directly from the pages of this Application. The interaction and information obtained through this Application are always subject to the Customer’s privacy settings for each social network. This type of service might still collect traffic data for the pages where the service is installed, even when Customers do not use it.

6.1. Facebook Like button and social widgets (Facebook, Inc.)

The Facebook Like button and social widgets are services allowing interaction with the Facebook social network provided by Facebook, Inc.

The Twitter Tweet button and social widgets are services allowing interaction with the Twitter social network provided by Twitter Inc.

The Linkedin follow button and social widgets are services allowing interaction with the Linkedin professional network provided by Linkedin Corporation.

7. Registration and authentication

By registering or authenticating, Customers allow this Application to identify them and give them access to dedicated services. Depending on what is described below, third parties may provide registration and authentication services. In this case, this Application will be able to access some Data, stored by these third party services, for registration or identification purposes.

7.1. Google OAuth (Google Inc.)

Google OAuth is a registration and authentication service provided by Google Inc. and is connected to the Google network.

7.2. Microsoft Authentication (Microsoft Inc.)

Information collected: authentication data as specified in the Microsoft privacy policy. Place of processing: US – Privacy Policy

In addition, third party applications and pixels are used for analyzing/improving the user experience and also for targeted advertising. The list includes: Google ads, Facebook ads, Linkedin ads and Microsoft clarity.

8. Marketing

8.1. Types of marketing

We send regular emails through email marketing automation systems. We also use third-party advertising services like Facebook, Google, and other ad networks and ad servers to deliver advertising about our services on other websites and applications you may use. The ads may be based on your recent activity, activity over time, and/or activity on other sites and services and may be tailored to your interests. We may use mobile or browser notifications to keep you up to date of new features and content. When you start a free trial of our product or request a demo, you may also receive a call from our sales representatives.

8.2. Personal Data used for Marketing

Advertising services may place cookies or other tracking technologies on your computer, phone, or other devices to collect data about your use of our services, and may access those tracking technologies in order to serve tailored advertisements to you. To help deliver tailored advertising, we may provide these service providers with a hashed, anonymized version of your email address (in a non-human-readable form) and content that you share publicly on AI Planet.

Your time zone, email address, first and last name may be stored in Sendy (Privacy Policy) and Amazon SES (data protection policy), which are third-party services we use to manage our email communication channels with our community.

Here is a non-exhaustive list of the various advertisement services we are using. Please consult their individual privacy policies to find out what personal data they are collecting.

9. Additional information about Data collection and processing

9.1. Legal action

The Customer's Personal Data may be used for legal purposes by the Data Controller, in Court or in the stages leading to possible legal action arising from improper use of this Application or the related services. The Customer declares to be aware that the Data Controller may be required to reveal personal data upon request of public authorities.

9.2. Additional information about Customer's Personal Data

We do not sell, lease, rent or give away the information collected about You without your permission. We only disclose your information as described below. If we disclose your information, we require those we share it with to comply with adequate privacy and confidentiality requirements, and security standards.

AI Planet Community

If you are a AI Planet Community member, we may list your username/name on a leaderboard if you participate in a Datathons/AI Challenges/Bootcamps. We may also share information about you with a potential employer if you opt for your information to be shared in order to connect with Datathons/AI Challenges sponsor companies.

Service Providers Processing Data on Our Behalf

We may use contractors and service providers to process the information collected about you on our behalf for the purposes described in this Privacy Policy. We contractually require service providers to keep information secure and confidential and we do not allow our data processors to disclose your information to others without our authorization, or to use it for their own purposes. However, if you have an independent relationship with these service providers their privacy statements will apply.

In addition to the information contained in this privacy policy, this Application may provide the Customer with additional and contextual information concerning particular services or the collection and processing of Personal Data upon request

More specifically, we share some of your personal data with the following external service providers:
  • Payment Providers: which take payment from you for our products and services and/or manage our subscriptions (this will be applicable to AI Planet for Business customers);
  • Customer Support Providers: which assists us in providing customer support services to you;
  • CRM and Customer Success Software Providers: which help us understand and manage the customer experience;
  • Infrastructure Services Providers: which help with delivery of our services;
  • Cloud Services Providers: which store your data and makes analytics reports for us to help develop our services;
  • Data and Analytics Providers: which help us understand customer behavior across our websites;
  • Survey Software Providers: which assist us in running surveys or customer tests; and
  • Advertising and Marketing Partners: which we use to contact you on their platforms, to send you personalized promotional materials and to deliver more targeted marketing messages.
System logs and maintenance

For operation and maintenance purposes, this Application and any third party services may collect files that record interaction with this Application (System logs) or use for this purpose other Personal Data (such as IP Address).

The rights of Customers

Customers have the right, at any time, to know whether their Personal Data has been stored and can consult the Data Controller to learn about their contents and origin, to verify their accuracy or to ask for them to be supplemented, cancelled, updated or corrected, or for their transformation into anonymous format or to block any data held in violation of the law, as well as to oppose their treatment for any and all legitimate reasons. Requests should be sent to the Data Controller at the contact information set out above.

Do-Not-Track

There are different ways you can prevent tracking of your online activity. One of them is setting a preference in your browser that alerts websites you visit that you do not want them to collect certain information about you. This is referred to as a Do-Not-Track (“DNT”) signal. Please note that our Websites may not recognize or take action in response to DNT signals from your browser.

10. Changes to this privacy policy

The Data Controller reserves the right to make changes to this privacy policy at any time by giving notice to its Customers on this page. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom. If a Customer objects to any of the changes to the Policy, the Customer must cease using this Application and can request that the Data Controller remove the Personal Data. Unless stated otherwise, the then-current privacy policy applies to all Personal Data the Data Controller has about Customers.

11. International Data Transfers

Your information, including personal data that we collect from you, will be transferred to, stored at, and processed by us and other third parties and companies within the AI Planet (DPhi Tech BV & its subsidiaries) outside of the country in which you reside.

12. Definitions and legal references

12.1. Personal Data (or Data)

Any information regarding a natural person, a legal person/company, an institution or an association, which is, or can be, identified, even indirectly, by reference to any other information, including a personal identification number.

12.2. Usage Data

Information collected automatically from this Application (or third party services employed in this Application), which can include: the IP addresses or domain names of the computers utilized by the Customers who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server's answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the Customer, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the Customer's IT environment.

12.3. Customer

The individual customer or business customer using this Application, which must coincide with or be authorized by the Data Subject, to whom the Personal Data refers.

12.4. Data Subject

The legal or natural person to whom the Personal Data refers.

12.5. Data Processor (or Data Supervisor)

The natural person, legal person, public administration or any other body, association or organization authorized by the Data Controller to process the Personal Data in compliance with this privacy policy.

12.6. Data Controller (or Owner)

The natural person, legal person, public administration or any other body, association or organization with the right, also jointly with another Data Controller, to make decisions regarding the purposes, and the methods of processing of Personal Data and the means used, including the security measures concerning the operation and use of this Application. The Data Controller, unless otherwise specified, is the Owner of this Application.

If you are using our services as part of AI Planet products towards Business/Universities, AI Planet is the data processor of your personal data. The organization that contracted with us for the subscription/collaboration is the data controller.

12.7. This Application

The hardware or software tool by which the Personal Data of the Customer is collected.

12.8. Cookies

Small piece of data stored in the e Customer's device. We use cookies to improve your experience and for analytical purposes.

A cookie is a commonly used automated data collection tool. Cookies are small text files that are placed on your computer or device by websites that you visit or HTML-formatted emails you open, in order to make websites work, or work more efficiently. We may use cookies, web beacons, pixel tags, or other similar technologies on the Websites to, among other things:

  • Authenticate you as a AI Planet Community member or AI Planet for Business/Universities Customer;
  • Collect statistics regarding your usage of the Websites;
  • Tailor information presented to you based on your usage of the Websites;
  • Help provide additional functionality to the Websites; and
  • Analyze use of our Services.
  • You may refuse to accept cookies by activating the appropriate setting on your browser. If a cookie blocking setting is selected on your browser, however, you may be unable to access certain parts of our Website or to receive certain Services.
12.9. Accessing, Updating, Correcting or Deleting Your Data

You are able to view and update much of the information collected about you through your AI Planet Community account, or AI Planet for Business/Universities account. If you wish to cancel your account or request that we no longer use your information to provide you Services, contact us via the information below. We will respond to your request to access or delete your information within 30 days. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

13. Links to third party websites?

The services may contain links to third party websites like the link for the website of an AI challenge organizer, external dataset, notebooks, etc. When you click on a link to any other website or location, you will go to another site, and another entity may collect personal or anonymous data from you. We have no control over, do not review, and cannot be responsible for these outside websites or their content. Please be aware that this Privacy Policy does not apply to these outside websites or content, or to any collection of your personal data after you click on links to such outside websites. We encourage you to read the privacy policies of every website you visit. The links to third party websites or locations are for your convenience and do not signify our endorsement of privacy policies of such third parties or their products, content, or websites.

14. Sharing of sensitive personal information

We ask that you not send us and that you do not disclose any sensitive personal data (i.e. information related to racial or ethnic origin, political opinions, religious or other beliefs, health information, biometrics or genetic characteristics, criminal background, trade union membership or information about your sex life or sexual orientation) or information like social security numbers on or through the services or otherwise to us.

15. Collection of personal data from children?

We do not intentionally gather personal data from visitors who are under the age of 13. If you believe that we might have done so, please contact us at [email protected]. When we learn that a child under 13 has submitted their personal data to AI Planet, we will try to delete the information as soon as possible if we do not have consent from the guardian.
